Steve, thank you so much for joining us. Tonight we want to talk about testamentary trusts, a specific type of trust created through a will. Can you elaborate on the unique characteristics of these trusts?
Certainly, Trisha. A testamentary trust is designed to take effect only upon the grantor’s death. Unlike living trusts which are established during the grantor’s lifetime, a testamentary trust goes through probate. Consequently, it becomes active after the will is probated and the terms of the trust are validated by the court.
There are several reasons why someone might choose a testamentary trust. It can be a valuable tool for parents who want to ensure their minor children are financially supported until they reach adulthood. Moreover, it allows for greater control over asset distribution and can protect assets from irresponsible spending or potential creditors.
Conversely, because it involves probate, the process of setting up and administering a testamentary trust takes longer and is generally more expensive than establishing a living trust.
Challenges with Testamentary Trusts
Steve, have you encountered any particular challenges when working with clients who opt for testamentary trusts?
Well, Trisha, one common issue stems from the fact that the terms of the trust are only finalized upon death. This means the grantor’s wishes might not reflect their current circumstances or desires if their life takes unexpected turns.
I recall a case where a couple established a testamentary trust for their daughter, intending to provide for her education. Unfortunately, she decided to pursue a different career path that didn’t require a traditional college degree. Had they used a revocable living trust, they could have easily amended the terms to better suit her needs.
Nevertheless, testamentary trusts still serve an important purpose for many families. I always emphasize the importance of regularly reviewing estate planning documents with clients to ensure they remain aligned with their evolving goals and circumstances.
