Protecting Our Elders: A Conversation with Ted Cook

Hello everyone, and welcome to today’s interview. I’m here with Ted Cook, an elder protection attorney practicing right here in sunny San Diego. Ted, thanks so much for taking the time to chat with me.

What Drives Your Passion for Elder Protection?

Ted: It’s a privilege to be able to help vulnerable seniors navigate some of life’s toughest challenges. Seeing them treated fairly and with dignity is incredibly rewarding. Many seniors face exploitation or abuse, and they often don’t know where to turn. That’s where I come in.

Tell Us About the Different Steps Involved in Elder Protection

Ted: Protecting our elders is a multi-faceted process. It starts with a thorough initial client engagement, including intake, consultation, and conflict checks. Then we move on to case assessment, identifying the legal issues at play and gathering evidence. Based on that, we take protective actions – this could involve anything from restraining orders to guardianship proceedings.

If necessary, we engage in legal proceedings like civil litigation or criminal prosecution. And finally, there’s long-term planning to ensure their future security through estate planning and advance directives.

Ted, Let’s Dig into the “Protective Actions” Step – Can You Elaborate?

Ted: Absolutely! This is often a critical phase where we take concrete steps to safeguard our clients. Depending on the situation, this could involve seeking emergency legal remedies like restraining orders against abusive family members or caregivers. We might notify Adult Protective Services (APS) if there’s suspected neglect or abuse.

And in cases of severe incapacity, we may petition for guardianship or conservatorship to ensure their well-being and financial security.

  • “Sometimes we need to act quickly,” Ted explains. “I remember one case where an elderly woman was being financially exploited by her own son. We were able to freeze her bank accounts and obtain a restraining order before he could drain her savings entirely.”
  • He continues, “Protecting vulnerable individuals requires swift action and careful legal maneuvering.”

“Ted Cook was incredibly compassionate and understanding during a difficult time for my family. He helped us navigate a complex situation involving my grandmother’s finances and ensured her best interests were protected.” – Sarah M., La Jolla

“I can’t thank Ted enough for his expertise and guidance. He made the entire process of setting up guardianship for my father so much easier than I anticipated.” – John K., Pacific Beach
